Welcome to Final Note. These Terms & Conditions (“Terms”) apply to your use of finalnote.co.za (the “Website”) and to all purchases made through it. By using the Website or placing an order, you agree to these Terms. Please read them carefully, together with our Privacy Policy, Delivery & Returns and Cookie Policy.
Nothing in these Terms limits or excludes any right you have under the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA) or any other law that cannot lawfully be limited.
1. Using the Website
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You agree to provide accurate and complete information and to keep your account login details confidential. You are responsible for all activity on your account.
You may not use the Website for any unlawful purpose, attempt to gain unauthorised access to it, or interfere with its operation.
2. Products
We take care to describe and photograph our products accurately. However, colours may vary slightly depending on your screen, and packaging may change from time to time. Product images are for illustration purposes.
Skin care and sun care: our products are for external use only. Please read the label, directions and warnings before use, and perform a patch test if you have sensitive skin. Discontinue use if irritation occurs. Sunscreen is one part of sun protection: re-apply frequently, especially after swimming, perspiring or towel drying, and avoid prolonged sun exposure.
Fragrances and diffusers: keep away from children, pets, heat and open flames. Diffuser oils may damage some surfaces; place diffusers on a stable, protected surface. Car diffusers should not obstruct the driver’s view.
3. Prices and payment
All prices are in South African Rand (ZAR) and are not subject to VAT. Delivery fees are shown separately at checkout before you pay.
We may change prices at any time, but changes will not affect orders already confirmed. If a product is listed at an obviously incorrect price because of an error, we will contact you and you may choose to proceed at the correct price or cancel for a full refund.
We accept the following payment methods:
- Card payments, processed securely by Yoco. We do not store your card details.
- EFT (electronic funds transfer). Our banking details are shown at checkout and in your order confirmation email. Please use your order number as the payment reference. Orders are processed and dispatched only once the payment reflects in our account.
4. Orders and acceptance
Placing an order is an offer to buy. An agreement is formed when we email you an order confirmation after payment has been received. We may decline or cancel an order, for example if a product is out of stock, if payment is not received, or if we suspect fraud. If we cancel an order you have paid for, we will refund you in full.
All products are subject to availability.
5. Delivery
We deliver to South Africa, Lesotho, Botswana and Namibia. Orders under R1 000 carry a R95 flat delivery fee; orders of R1 000 or more are delivered free of charge. Delivery times, fees and procedures are set out in our Delivery & Returns policy. Ownership and risk in the products pass to you on delivery.
6. Cooling-off, returns and refunds
You may cancel an online purchase within 7 days of receiving the goods, as provided for in section 44 of ECTA. Change-of-mind returns must be unused and unopened, and the return courier cost is for your account. Products that are defective or damaged are refunded in full, including the return courier cost, once they have been received and assessed. Full details are in our Delivery & Returns policy.
7. Promotions and discount codes
Promotions and discount codes are valid for the period stated, cannot be exchanged for cash, and cannot be combined unless stated otherwise. We may end a promotion at any time, without affecting orders already placed.
8. Intellectual property
The Final Note name, logo, monogram, product names, packaging designs, photographs, text and all other content on the Website belong to Forty4 Solutions (Pty) Ltd or its licensors and are protected by law. You may not copy, reproduce or use them without our written permission.
9. Limitation of liability
To the extent permitted by law, we are not liable for any indirect or consequential loss arising from the use of the Website or our products, or for any loss caused by misuse of a product or failure to follow its directions and warnings. Our total liability in respect of any order is limited to the price paid for that order. This clause does not limit any liability that cannot be limited under the CPA.
We aim to keep the Website available and free of errors and viruses, but we cannot guarantee uninterrupted or error-free access.
10. Privacy
We process your personal information in accordance with POPIA and our Privacy Policy.
11. Complaints and disputes
If you have a complaint, please contact us first at hello@finalnote.co.za and we will do our best to resolve it promptly. If we cannot resolve it, you may refer the matter to the Consumer Goods and Services Ombud (cgso.org.za) or the National Consumer Commission.
12. General
These Terms are governed by the laws of the Republic of South Africa. If any provision is found to be invalid, the remaining provisions remain in force. We may update these Terms from time to time; the version on the Website when you place your order applies to that order.
